Terms of Service
These terms are an agreement between your business ("you", the "customer") and LiftRoster, operated by Greg Normann, a sole proprietor based in Orange County, California ("LiftRoster", "we", "us"). They cover your use of liftroster.com, the LiftRoster web app, the operator course and related services (the "Service"). By creating an account or paying for a plan, you agree to these terms on behalf of your business. LiftRoster is built for businesses, not for personal or household use.
1. What LiftRoster is
LiftRoster is a training and recordkeeping tool for forklift (powered industrial truck) operators. It provides an online classroom course and quiz, a hands-on evaluation checklist, employer certificate and wallet card templates, renewal reminders, QR-code daily forklift checks and an audit packet. It helps employers meet OSHA 29 CFR 1910.178(l) operator training and 1910.178(q)(7) daily examination requirements, and Cal/OSHA Title 8 §3668.
2. The course is the classroom portion only
- The LiftRoster course covers formal (classroom) instruction only.
- Before anyone operates a forklift, you, the employer, must provide hands-on practical training and an evaluation of each operator's performance in your workplace, done by a person with the knowledge, training and experience to train and evaluate operators.
- You, the employer, certify each operator. LiftRoster does not certify operators, and nothing in the Service is "OSHA certification" or "OSHA approval". LiftRoster is not affiliated with or endorsed by OSHA or Cal/OSHA.
- You are responsible for training on the specific forklift types, attachments and workplace conditions at your site, and for refresher training and re-evaluation when required.
3. Not legal or safety-consulting advice
The Service and our website give general information to help you organize your training and inspection program. They are not legal advice and do not replace your own review of the regulations that apply to you, or advice from your attorney, insurer or safety professional. You remain responsible for your own compliance and workplace safety.
4. Accounts
- You must give accurate information and keep your login details secure. You are responsible for activity under your account, including by managers you invite.
- Operator PINs and course links are meant for the operator they belong to. Tell us right away at [email protected] if you think your account has been misused.
5. Plans, billing and automatic renewal
Your plan renews automatically until you cancel. Monthly plans renew and are charged every month, and yearly plans renew and are charged every year, at the price shown when you sign up (currently Crew $99/month or $990/year, Facility $199/month or $1,990/year, or the price in your written quote), plus any applicable tax, to the payment method you used at checkout. There is no minimum term.
- Plans are priced per site and billed in advance, monthly or yearly, as shown on our pricing page or in a written quote. Payments are processed by Stripe; we do not store your full card number.
- Subscriptions renew automatically at the end of each billing period until canceled. You can cancel any time; your plan stays active until the end of the period you already paid for, and you won't be charged again.
- How to cancel: email [email protected] from your account owner's email, or call or text (928) 490-0587. We'll cancel future renewals promptly and confirm by email. If a "Manage billing" link appears on your Team & plan page, you can also cancel there yourself.
- For yearly plans, we'll email you a reminder before each yearly renewal.
- Prices may change. We'll tell you at least 30 days before a price change applies to your next renewal.
- Prices do not include taxes, which you are responsible for where they apply. Hands-on evaluation visits and on-site setup are quoted and billed separately.
6. 30-day money-back guarantee
If LiftRoster isn't right for you, email [email protected] within 30 days of your first subscription payment and we'll refund that payment in full. After 30 days, payments are non-refundable except where the law requires otherwise, and canceling stops future renewals; you keep access through the end of the period you paid for. The guarantee applies to your first subscription payment, not to separately quoted on-site services that have already been performed.
7. Acceptable use
You agree not to:
- enter false training, evaluation or inspection records, or use the Service to misrepresent an operator's training status;
- let anyone operate a forklift based only on completing the online course;
- upload anything unlawful, or personal information you have no right to share;
- try to break, overload, reverse engineer or get around the security of the Service, or access another customer's data;
- resell or share the Service outside your business without our written permission.
We may suspend accounts that break these rules or put the Service or other customers at risk. We'll tell you why when we can.
8. Your data
You own the records you put into LiftRoster, such as operator names, training and evaluation records, certificates and daily check logs. You give us permission to store and process them only to provide and support the Service. See our Privacy Policy for details, including how to get a copy of your data.
9. Availability and changes
We work to keep LiftRoster available and accurate, but the Service is provided "as is" and "as available". We may improve or change features over time. Keep your own copies of records you are legally required to keep, for example by printing or saving the audit packet and certificates as PDFs.
10. Limitation of liability
To the fullest extent the law allows: (a) LiftRoster is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, fines, penalties or citations; (b) LiftRoster is not responsible for workplace injuries, accidents or property damage, or for your training, evaluation, certification or inspection decisions; and (c) our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim. Some of these limits may not apply where the law does not allow them.
11. Ending the agreement
You can stop using LiftRoster and cancel at any time, as described in section 5. We may end these terms if you materially break them and don't fix it after notice. After your account closes you can ask for a copy of your data, as described in the Privacy Policy.
12. Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in California.
13. Changes to these terms
We may update these terms. If a change is significant, we'll post it here and notify account owners by email before it takes effect. Continuing to use the Service after that means you accept the updated terms.
